Struggling with Probate forms

“When my father died I was finding it hard enough coming to terms with his death and then I had to begin the task of completing the probate forms since I was named Executor of the will. I had no idea as to what this process entailed.

I called the EWP and they talked me through the process of obtaining a grant of probate and helped me identify what documents were necessary in order to take out a grant of probate. Filling out forms concerning my father’s financial affairs was a nightmare but the EWP talked me through the process and what monies and transactions were relevant to the forms especially in relation to the Revenue affidavit. They explained to me that I would need to attend an interview at the District Probate Registry for the area in which my father resided at the date of death to confirm the details entered on the forms and to answer any queries.

The information given helped me to complete this process more accurately and swiftly.”

Speeding on the motorway

“I was caught speeding on the motorway. I had previously been caught on another two occasions and had 6 points on my license already. My office is located quite a distance away and I was extremely worried about how this third offence was going to affect me.

I was aware that this was a serious offence but had no idea what penalty I could expect. I called the EWP to find out what fine I could expect and if I could be banned from driving and what length this ban could be expected to last for. They explained to me penalty points remain on the license of a driver for a period of 3 years and an accumulation of 12 points at any time within a 3 year period would lead to automatic disqualification for 6 months.

They explained to me that I should opt to pay the fixed charge of 80 euro within 28 days issue of the Fixed Charge Notice from the Gardai effectively pleading ‘no contest’ and 2 points will be endorsed on my license. They explained to me that if I was convicted of the offence I would receive 4 penalty points and a fine above 800 euro as this was not a first time offence. The court would take into account factors such as the time of day, road conditions and the use of my car for work reasons.

They outlined all the facts and ensured me that it was best to pay the fine immediately. They couldn’t take away the offence I committed but they supported me through the stress of this. I am also aware now that I have 8 points in total on my license and that another 4 will lead to disqualification.

EWP sent me information on in relation to travel and motoring in particular penalty points and a list of the offences that will incur these points.”

Marriage Break-up

“I contacted the EWP as the process of separating from my husband had become very complex. EWP helped me by providing information and practical help to deal with the issue of the family home and mortgage repayments since my husband and I were behind in our payments.

I was very worried about losing my home as my husband was refusing to continue to pay the mortgage even though the house was in joint ownership. EWP reassured me of the legal stance regarding the family home and sent me out easy to understand literature on my legal rights in relation the family home following a separation.

They outlined that both owners were equally responsible for meeting the cost of repayments, so both spouses are jointly and severally (separately) liable for the mortgage repayments under the terms of the mortgage deed.

They told me that I must contact the Bank as soon as possible to try to come to some agreement regarding the payments. Regarding the refusal of my husband to make payments, they outlined that I may make an application to the court and that the court will make such orders as it sees fit to protect the family home.

The EWP also provided me with a list of solicitors in my area. I found that providing me with information on these practical problems of a separation helped me deal with them more effectively and this support was crucial in helping me through this difficult time.”

Family Breakdown

My first contact with EAR Ireland was following a breakdown in my family unit. From that first telephone conversation they gave me emotional support and some perspective in what was happening to me and also put me in touch with specialist legal services in my local area to help me with my difficulties. Throughout the last three years I have contacted Employee Advisory Resource on numerous occasions and they have provided continuous support and extensive knowledge of different areas which included legal, financial, emotional, and child support.

Childcare

The service I have been given has been absolutely wonderful. I now have dossiers of information on childcare and have narrowed my search considerably. The saving to my time has been incalculable as I would never have been able to compile such a comprehensive pack of information for myself. I also received support around balancing parenting and work and received numerous helpful fact sheets on this. It is comforting to know that there is someone on the end of the phone who can support me through this process as well as give practical advice.

Landlord Problems

Over the last six months I have had to take my ex-landlord to court. I just wanted to say that my contact with my EAR-Ireland specialist was invaluable. My calls were always returned promptly and he talked me through every procedure and step along the way - I literally couldn't have done it without that help!
